Maynor Francisco Hernandez-Rodas, a 38-year-old illegal immigrant from Guatemala, was re-arrested by ICE agents in Massachusetts after being released by the state’s court system despite facing charges of aggravated child rape.
Hernandez-Rodas was first arrested by local authorities in June, but a court decision to ignore an ICE detainer allowed him to go free, leading to his capture by Enforcement and Removal Operations (ERO) agents in Lowell on September 20.
Hernandez-Rodas, a known criminal with prior convictions in Connecticut, entered the US illegally as one of the many “gotaways” who cross the border undetected. ICE officials expressed frustration over the court’s decision, calling him a “significant danger” to the community. The suspect’s criminal history includes convictions for breach of peace in 2011 and 2016, but despite his illegal status and violent charges, he was allowed to walk free.
The case has raised questions about the current state of immigration enforcement under the Biden-Harris administration. The rate of deportations for illegal immigrants with criminal records has dropped by 74% during this administration, even as the number of illegal border crossings remains high.
